Common Real Estate Scams and How to Avoid Them

The real estate sector presents incredible opportunities, whether you’re purchasing your dream home, investing in rental property or relocating to a new apartment. However, like any lucrative industry, real estate is not immune to fraud. Every year, unsuspecting buyers, renters and investors fall victim to scams that cost them time, money and peace of mind. Fortunately, most of these schemes can be avoided with the right information and a cautious approach. One of the most common scams is the use of fake property listings. Scammers create attractive online ads featuring below-market prices and professionally edited photos to lure in victims. Once interest is sparked, they request deposits or viewing fees upfront and then vanish without a trace. To protect yourself, never send money before physically inspecting the property. If you can’t visit in person, send someone you trust. Always verify the agent’s identity. In Kenya, you can confirm this through the Estate Agents Registration Board. Title deed fraud is another alarming tactic. Here, fraudsters may sell properties using forged documents or impersonate the real owners. Victims often only discover the truth after making significant financial commitments. Red flags include sellers who insist on private transactions without legal involvement, altered documents or refusal to share original papers. The best defense is to conduct an official title search at the Ministry of Lands or the e-Citizen portal, involve a licensed advocate and cross-check ownership with the land registry. A more deceptive scam involves phantom properties. In these cases, the scammer offers to rent or sell a property that either doesn’t exist or isn’t theirs to offer. They may rely solely on photographs and apply pressure tactics, claiming the property will be taken by someone else if you delay. Always insist on visiting the property physically. Speak to neighbors if possible and check property details against official records to ensure they’re legitimate. Bogus real estate agents are also a growing concern. Some scammers impersonate licensed professionals or operate under fake agencies with impressive-looking websites. They collect deposits or commissions and then disappear. Warning signs include a lack of verifiable office location, no professional ID or license and evasive or inconsistent communication. Before engaging an agent, ask for their registration number, check online reviews and work with agents affiliated with recognized agencies. Off-plan development scams have also become increasingly common, especially in growing urban areas. Buyers are promised luxurious units or fast investment returns in properties that are still under construction. Unfortunately, in many cases, construction never begins or stalls indefinitely. To safeguard your investment, ensure the developer is registered and has building permits. Request a clear payment plan with legal safeguards and always have a lawyer review contracts and conduct background checks on the developer. Another dangerous scheme is the double selling of property. This occurs when a seller fraudulently sells the same property to more than one buyer, often using forged or duplicated documents. Red flags include the seller pushing for quick transactions and discouraging legal involvement. If the deal sounds too good to be true, it probably is. To protect yourself, register a caveat after signing a sale agreement to prevent others from being sold the same property. Conduct a comprehensive search at the land registry and never forgo legal representation, even when the seller appears trustworthy. Real estate scams are on the rise, but with vigilance and informed decision-making, you can avoid becoming a victim. Always take your time to verify all information, ask questions and involve professionals throughout the process. Whether you’re buying, renting or investing, your property journey should be exciting not stressful or regretful. Awareness is your strongest safeguard.
